ParaGard IUD Injury Lawyer

As patients, we trust our doctors implicitly. They are the experts, and we rely on their knowledge and professionalism when at our most vulnerable and when dealing with our most intimate issues.  We can’t all be medical experts. Physicians, in turn, rely on the representations of medical device manufacturers and pharmaceutical companies. While we expect our doctors to do their homework, at some point, they have to trust that a product placed in the market is fit for use by their patients. And we, the patients, rely on that same trust. Unfortunately, medical device manufacturers occasionally betray that trust by putting a product on the market that is dangerously defective. When they do, people get hurt.

If you or a loved one have a ParaGard IUD, your health could be at risk, and you might have a claim for damages. The medical device defect attorneys at Morris Law Firm help clients who have suffered illness or injury as a result of ParaGard IUD implants recover compensation for the harm they have suffered. We will investigate your case, help you get the medical care you need, and fight to make sure that the companies responsible for putting a dangerously defective product on the market are held to task for the damage they have done.

What is the ParaGard IUD?

The ParaGard IUD is a copper-based intrauterine birth control device (IUD), manufactured and marketed in the United States by The Cooper Companies.  Previously, it was sold by an Israeli company called Teva Pharmaceuticals.

Unlike other birth control devices, the ParaGard IUD uses copper instead of hormones. It is a T-shaped device installed via surgery into the body; the copper produces an inflammatory reaction in the uterus that works as a spermicide, reducing (or preventing) the likelihood of egg fertilization and pregnancy. It is meant to be a minimally-invasive, long-term, and reversible form of contraception.

ParaGard is marketed as being “over 99% effective.” The manufacturer also touts the fact that removal of the ParaGard IUD is meant to be a quick, non-surgical procedure accomplished in mere minutes during a doctor visit.  Unfortunately, this is not always the case.

What’s Wrong With the ParaGard IUD?

Over the last decade, thousands of ParaGard patients have reported that the ParaGard IUD has caused unexpected breakage, perforation, and migration.  The device is also susceptible to breaking upon removal, despite the product marketing claiming that removal is a simple and easy process.  Patients with a failed ParaGard have faced botched removals, requiring invasive surgical procedures to correct the damage caused.  The IUD’s “arms” are known to break upon removal and even long before removal.

The defective product and invasive corrective surgeries can cause a variety of damages to patients with a faulty ParaGard IUD installed.  Patients experience severe menstrual pain, cramps, heavy bleeding, and spotting, as well as infection, inflammation, perforated organs, urinary tract problems, and even infertility.

Do I Have a ParaGard IUD Injury Claim?

If you have a ParaGard IUD installed currently, or if you have previously had a ParaGard IUD and experienced complications before, during, or after removal, you may have a claim against Teva and/or Cooper.  Potential plaintiffs include those who have had to undergo invasive surgical procedures after an attempted ParaGard removal, including:

  • Laparoscopy, an abdominal or pelvic surgery
  • Hysteroscopy, a procedure in which a doctor inspects the uterine cavity by way of the cervix with a thin camera attached to a small tube-like device
  • Hysterectomy, the surgical removal of the uterus
  • Laparotomy, a cesarean section-like surgical procedure

Patients who have experienced complications with the ParaGard may also have a claim for damages, even if they did not require these serious medical procedures.  If you or someone you care about has or previously had a ParaGard IUD and has faced pain, internal damage, or surgical complications, talk to a knowledgeable defective medical device attorney to learn if you have a claim for damages.
