Rollover Accident Lawyer

Rollover Accident Injuries: Los Angeles & Nationwide

While all car accidents can be jarring and dangerous, rollover accidents are likely to be especially devastating. When one or both vehicles fully tip or rollover as a result of a high-speed impact, vehicle imbalance, and other factors, any occupants are likely to suffer catastrophic injuries. At Morris Law Firm, our rollover accident lawyer will help you and your family recover after a serious rollover crash involving an 18-wheeler or commercial vehicle.

What Causes a Rollover Accident?

Many factors can contribute to the likelihood of a rollover accident. Like all car accidents, however, nearly every rollover crash happens because someone at some stage was negligent. If everyone involved, from the auto manufacturers to the people who loaded the truck to the drivers, were all acting responsibly and safely, then almost no crashes would ever happen.

At Morris Law Firm, we know how to investigate the circumstances of a rollover accident to determine what went wrong and who was to blame. We’ll look into the various causes that factor into the likelihood of a rollover accident, including the following:

  • Type of vehicle. Some types of vehicles are more prone to rolling over than others. Large trucks and other vehicles with a high center of balance are more likely to roll over. Sport-utility vehicles (SUVs) are much more likely to roll over than passenger cars, as are pickup trucks. Older vehicles are significantly more likely to roll over than newer models as well. SUV and truck drivers must adjust their behavior to account for the worse balance.
  • Driver behavior. At the end of the day, driver-related factors are the largest contributors to the likelihood of a rollover accident. Drivers who speed, pass on the right, take sharp turns at high speeds, or engage in other reckless behavior are much more likely to roll over. Drunk drivers, drowsy drivers, drugged drivers, and distracted drivers are more likely to blow through stop signs or stoplights and otherwise drive unsafely, increasing the risk of a T-bone crash or other high-speed incident leading to a rollover.
  • Vehicular defects. Sometimes vehicles are built defectively. The truck bed might not be properly affixed to the truck, leading to increased volatility. The vehicle itself may have been designed with poor balance or equipped with a faulty engine, brakes, or steering. Any vehicle defects make a rollover accident more likely.
  • Vehicle balance. Larger vehicles are more likely to be off-balance. This is especially true with cargo vehicles such as tractor-trailers and semi-tractors. If the cargo is loaded improperly in the truck bed, if the vehicle is overloaded with too much weight, or if the cargo is not secured properly, then the driver is more likely to lose control of the vehicle and the vehicle is more likely to tip or rollover.
  • Road and weather conditions. Rollover accidents are significantly more likely to occur on wet or icy roads when inclement weather makes safe driving more challenging. Rain, snow, heavy winds, and fog make vehicle operation more tricky and increase the chances that a vehicle will roll over when rounding a sharp turn or when crashing into another vehicle. Drivers operating vehicles in inclement weather or during dangerous road conditions are responsible for being on extra-high alert, and drivers who fail to take the conditions into account are liable for any injuries they cause.

Who’s Liable After a Rollover Accident?

Liability after a rollover accident depends on who was at fault, which depends in turn on who was negligent or reckless. In most cases, a negligent driver was responsible for the crash. Morris Law Firm will help you hold negligent drivers responsible for any injuries they cause. However, depending on the circumstances of your crash, several other parties can be liable as well.

If your crash was caused by an unbalanced load, the fault may lie with the vehicle manufacturer, with the contractors who loaded the truck, or with the freight company or truck operator. Accidents caused by defective vehicles should be paid for by the auto manufacturer. If rollover accidents happen regularly on a particular stretch of road, the municipality or state that designed the intersection or that is responsible for maintenance may be held liable.
